GHARAR DI SISTEM PENDIDIKAN TINGGI ISLAM INDONESIA

Abstract

Halim Faqihuddin Annasr This study is intended to determine whether there is an element of Gharar in Indonesian Islamic Universities or not. The research method used is descriptive qualitative method with the process of data analysis. After going through the research, it was concluded that there was an element of Gharar but it was small which did not affect an existing contract. Every contract issued must be considered first based on the applicable fikih rules. So both parties must really understand what type of contract will be used so that it can be free from the elements of Gharar. A socialization is also needed to provide more knowledge about what a contract is in accordance with the rules of not out of sharia.
